The Crown Prosecution Service authorised the latest charges against Andrew Tate and Tristan Tate following review of a new evidence file, resulting in their swift detention by American law enforcement. Andrew Tate faces seven counts of rape together with allegations of sex trafficking and child pornography offences involving seven victims, while his brother faces one count of sexual assault, two counts of rape and three counts of trafficking. All the alleged offences occurred between July 2010 and August 2017.
The CPS said these charging decisions followed receipt of a further file of evidence from Bedfordshire Police. US Marshals confirmed the brothers are now in federal custody, with the Department of Justice stating that extradition to Britain will proceed. The Tates have previously denied any wrongdoing.
Reuters reported in May 2025 that the CPS had already authorised 21 charges against the brothers, including rape, actual bodily harm and human trafficking said to have taken place from 2012 to 2016. Andrew Tate was linked to 10 of those counts concerning three women, while Tristan Tate faced 11 counts relating to one woman. Lawyers for the pair indicated at the time they intended to return voluntarily to the UK once Romanian proceedings allowed.
Romanian prosecutors arrested the brothers in December 2022 on suspicion of forming an organised crime group to carry out human trafficking and rape, according to statements from Bucharest authorities. The Romanian investigation later expanded to money laundering, trafficking minors and witness interference, with additional property raids conducted in 2024. A court in Romania lifted certain remaining restrictions in April 2026 while the core probe continued.
NBC News reported that the brothers departed Romania in February 2025 after a travel ban was lifted, at which point they entered the United States where a separate federal investigation had been opened. Florida Attorney General James Uthmeier launched that inquiry shortly after their arrival, with Governor Ron DeSantis declaring them unwelcome in the state. The developments added another layer to cases now active across three countries.
British police first obtained an arrest warrant for the Tates in March 2024, which preceded the formal charging process and extradition request now being actioned in the United States. The CPS has stressed that all decisions rest on evidence gathered by investigators. The brothers, who hold dual British and American citizenship, remain in custody pending further court hearings on their transfer.
