Victoria’s Court of Appeal on October 30 2026 dismissed Erin Patterson’s appeal against her convictions for three murders and one attempted murder while upholding a prosecution challenge that produced a harsher sentence. The judges ruled that the original non-parole period of 33 years was manifestly inadequate for what they termed extraordinarily cold and calculated offending that required the strongest denunciation. Justice Stephen McLeish speaking on behalf of the panel concluded that the shocking criminality involved made it inappropriate to fix any non-parole period ensuring Patterson will never be released. Patterson served beef Wellington containing foraged death cap mushrooms to her estranged husband’s parents Don and Gail Patterson and Gail’s sister Heather Wilkinson at a lunch in Leongatha in July 2023 according to evidence accepted by the jury. The three victims died within days from liver failure while Ian Wilkinson the fourth guest and a pastor survived after weeks in hospital. A subsequent investigation recovered a dehydrator with Patterson’s fingerprints and traces of the toxic mushrooms that were also found in urine samples from some of those who fell ill the Court of Appeal noted. Following an 11-week trial in 2025 a jury convicted Patterson on all counts and she received life sentences with a 33-year non-parole period at a hearing the next month. Prosecutors appealed that term as too lenient while Patterson’s lawyers raised seven grounds alleging a miscarriage of justice including issues with jury accommodation during the proceedings. The Court of Appeal rejected every defence argument and allowed the sentence appeal according to the judgment delivered in Melbourne. Justice McLeish said Patterson’s murderous intent had been sustained from the time the invitations were issued through the preparation and serving of the meal in what amounted to a cruel breach of trust. The conduct featured an elaborate series of deceptions that included false claims about cancer to keep her children away false denials of foraging the mushrooms and the destruction of evidence he stated. These findings supported the decision to remove any possibility of parole after anxious consideration of the calculated criminality. The outcome makes Patterson only the second woman in Australia to be imprisoned for life without parole a rarity that legal experts attributed to the premeditated family betrayal and prolonged suffering inflicted on the victims. Academics from the University of Sydney and Monash University writing in an analysis said the ruling reflected the gravity of such deceptive murders under Australian sentencing principles. Patterson who appeared via video link from prison now has 28 days to consider whether to seek leave for a High Court appeal. Death cap mushrooms account for more than 90 percent of fungal poisoning fatalities worldwide and have caused multiple deaths in Australia including four in one Medical Journal of Australia study of 12 cases from the Australian Capital Territory and New South Wales between 2000 and 2012. That research found a high rate of hepatotoxicity despite treatments such as silibinin and noted that one mushroom cap can prove lethal for an adult. A separate Fungimap overview warned that the species produces delayed symptoms followed by severe organ damage with a mortality rate around 50 percent if untreated. The case has drawn global attention since Patterson’s arrest in November 2023 producing widespread coverage and announcements of planned dramatised television versions according to several reports. She has been held in a maximum security facility since her charging and the fresh whole-of-life term is backdated to that period. The Court of Appeal’s decision ends her immediate legal challenges though further action remains possible within the set timeframe.
